1. Acceptance of Terms

By accessing or using any website, application, or service provided by Lome Labs, LLC ("Lome Labs," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our services.

Your continued use of our services after any changes to these Terms constitutes your acceptance of the revised Terms.

2. Description of Services

Lome Labs builds and publishes software applications, including mobile apps distributed through the Apple App Store, and maintains a website at lomelabs.dev. Our services include, but are not limited to:

• Mobile applications and iMessage extensions for Apple platforms.
• Web-based content, including product information, blog posts, and documentation.
• Any related features, tools, or functionality we make available.

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

3. User Responsibilities

When using our services, you agree to the following:

• You will use our services only for lawful purposes and in accordance with these Terms.
• You will not use our services in any way that could damage, disable, overburden, or impair our systems or interfere with any other party's use of our services.
• You will not use our services to transmit harmful, threatening, abusive, or otherwise objectionable content.

3.2 Prohibited Activities

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any Lome Labs application or service.
• Attempt to gain unauthorized access to our systems, servers, or any data not intended for you.
• Copy, modify, distribute, sell, or lease any part of our services or software without our express written permission.
• Use automated scripts, bots, or scrapers to access or collect data from our services without prior authorization.
• Remove, alter, or obscure any proprietary notices, labels, or marks on our services.

3.3 Age Requirement

You must be at least 13 years of age to use our services. By using our services, you represent and warrant that you are at least 13 years old. If we learn that we have collected personal information from a user under 13, we will take steps to delete that information and terminate the associated account.

4. Intellectual Property

All content, features, functionality, software, designs, text, graphics, logos, and other materials available through our services are owned by Lome Labs, LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in our services or content beyond a limited, revocable right to use them in accordance with these Terms. You may not use our trademarks, logos, or brand assets without our prior written consent.

5. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, LOME LABS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any content made available through our services.

Your use of our services is at your sole risk. Any material downloaded or otherwise obtained through our services is accessed at your own discretion and risk.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOME LABS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OUR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Termination

We may terminate or suspend your access to our services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

You agree to indemnify, defend, and hold harmless Lome Labs, LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use or misuse of our services; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of such courts.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page. Changes become effective immediately upon posting unless otherwise stated.

It is your responsibility to review these Terms periodically. Your continued use of our services after changes have been posted constitutes your acceptance of the revised Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
