End User License Agreement

1. Agreement

This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("you" or "User") and Lome Labs, LLC ("Lome Labs," "we," "us," or "our"), governing your use of any software application published by Lome Labs (each, an "App" or "Application"). By downloading, installing, or using any Lome Labs App, you agree to be bound by the terms of this Agreement.

If you do not agree to these terms, do not download, install, or use the App.

2. License Grant

Subject to the terms of this Agreement, Lome Labs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use and in accordance with the App's documentation and applicable usage rules, including those set forth by the Apple App Store Terms of Service.

This license does not grant you any ownership interest in the App. It is a license to use the App, not a sale of the App or any copy thereof.

3. Restrictions

You agree that you will not, and will not permit others to:

• Copy or duplicate: Reproduce, copy, or duplicate the App or any part thereof, except as expressly permitted by this Agreement or applicable law.
• Modify or create derivatives: Modify, adapt, translate, or create derivative works based on the App or any part thereof.
• Distribute or transfer: Distribute, sell, lease, rent, lend, sublicense, or otherwise transfer the App or any rights therein to any third party.
• Reverse engineer: Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying algorithms, or structure of the App, except to the extent expressly permitted by applicable law notwithstanding this restriction.
• Remove notices: Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App.
• Misuse: Use the App for any unlawful purpose, or in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.

4. Ownership

The App, including all code, graphics, user interface designs, images, audio, text, and other content, as well as all related intellectual property rights, are and shall remain the exclusive property of Lome Labs, LLC. This Agreement does not convey to you any ownership rights in the App or any intellectual property therein.

All trademarks, service marks, trade names, and logos displayed in the App are the property of Lome Labs, LLC or their respective owners. You are not granted any right or license to use any such marks.

5. Third-Party Services

Our Apps integrate with and rely upon third-party platforms and services, including but not limited to:

• Apple iMessage: Certain Apps function as iMessage extensions and operate within Apple's Messages framework.
• Apple App Store: Apps are distributed through the Apple App Store and are subject to Apple's terms and conditions.
• Apple Sign in with Apple: Certain Apps use Sign in with Apple for user authentication.
• Supabase: Cloud database and authentication platform used for user accounts, game data storage, and real-time multiplayer synchronization. Privacy policy: supabase.com/privacy
• PostHog: Product analytics platform used to track app usage and improve the experience. Privacy policy: posthog.com/privacy
• Google AdSense: Advertising platform used to serve non-personalized ads to non-premium users. Privacy policy: policies.google.com/privacy
• Railway: Cloud hosting platform used to run our application server. Privacy policy: railway.app/legal/privacy

Your use of third-party services is governed by the respective terms and privacy policies of those third parties. Lome Labs is not responsible for the practices or availability of any third-party services.

6. Termination

This license is effective until terminated. Your rights under this Agreement will terminate automatically and without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy all copies, full or partial, of the App in your possession or control.

Lome Labs may also terminate this Agreement at any time for any reason. Sections 4 (Ownership), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Apple-Specific Terms), and 10 (Governing Law) shall survive any termination of this Agreement.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOME LABS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

LOME LABS DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE APP.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOME LABS, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

IN NO EVENT SHALL LOME LABS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE APP, IF ANY. IF YOU HAVE NOT PAID ANY AMOUNT FOR THE APP, LOME LABS' TOTAL LIABILITY SHALL NOT EXCEED FIFTY DOLLARS ($50.00).

9. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• Acknowledgment: This Agreement is between you and Lome Labs, LLC only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• Scope of license: The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and support: Lome Labs is solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services with respect to the App.
• Warranty: Lome Labs is solely responsible for any product warranties, whether express or implied by law. In the event of a warranty failure, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Product claims: Lome Labs, not Apple, is responsible for addressing any claims relating to the App or your use of it, including but not limited to product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Intellectual property: In the event of a third-party claim that the App infringes that third party's intellectual property rights, Lome Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Georgia.

11. Changes to This Agreement

Lome Labs reserves the right to modify this EULA at any time. Updated versions will be posted with a revised effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Agreement. We encourage you to review this Agreement periodically.
